Terms & Conditions

These Terms & Conditions ("Agreement") govern the relationship between Atria Works ("we", "us", "our", "the Studio") and any person or entity ("Client", "you") who engages our interior design services or uses our website at atriawor. By proceeding with a service engagement or using our website, you accept these terms in full.
1. Definitions
- "Service" โ any interior design service offered by Atria Works, including Courtyard Conversation, Spatial Architecture & Design, and Construction Companionship.
- "Project" โ the interior space or spaces to which the Service applies.
- "Deliverables" โ design documents, drawings, 3D visualisations, written briefs, and specifications produced in connection with a Service.
- "Contractor" โ any third-party tradesperson or construction firm engaged separately by the Client.
2. Acceptance of Terms
By requesting a service, making payment, or proceeding following receipt of a proposal, you confirm that you have read and agree to these Terms. You must be at least 18 years of age and have legal capacity to enter into a binding agreement. If you are engaging on behalf of a company, you represent that you have authority to bind that company.
3. Services Offered
Atria Works provides three primary interior design services in Malaysia:
- Courtyard Conversation (MYR 440) โ Initial spatial consultation, including site visit, written brief, and visual references. Delivered within one week.
- Spatial Architecture & Design (MYR 3,300) โ Full interior design service including spatial planning, material specification, 3D visualisation, and complete design documentation. Timeline of 6โ10 weeks.
- Construction Companionship (MYR 1,700) โ On-site support throughout renovation including contractor management, material sourcing, and final arrangement. Duration of 8โ14 weeks.
Each service is available independently or in combination. Service scope is defined at time of engagement.
4. Proposals & Scope
Each engagement begins with a written proposal confirming the specific scope of work, deliverables, timeline, and fee. The proposal forms part of this Agreement once accepted by the Client. Changes to scope after acceptance require a written amendment and may affect fees and timelines.
5. Payment Terms
- A 50% deposit is required before any work commences.
- The remaining balance is payable upon delivery of the final deliverable for the relevant Service.
- For Construction Companionship, milestone-based invoicing may be agreed in writing prior to commencement.
- All fees are in Malaysian Ringgit (MYR) and are exclusive of materials, contractor costs, and third-party purchases unless otherwise stated.
- Late payments (beyond 14 days of invoice date) may result in suspension of service delivery.
6. Revisions
The Spatial Architecture & Design service includes two revision rounds. Each round is initiated in writing. Additional revisions beyond the included rounds are available at MYR 350 per round, confirmed in writing before commencement.
7. Intellectual Property
All Deliverables produced by Atria Works remain the intellectual property of Atria Works until full payment is received. Upon receipt of full payment, the Client is granted a non-exclusive, non-transferable licence to use the Deliverables for the Project described in the proposal. Deliverables may not be reproduced, sold, or adapted for other purposes without prior written consent from Atria Works.
8. Client Responsibilities
- Provide accurate information about the project space, including existing dimensions and any structural limitations.
- Make decisions within the timeframes agreed in the proposal to avoid delays.
- Engage and manage contractors independently unless Construction Companionship has been commissioned.
- Ensure site access at times agreed for visits and quality reviews.
9. Confidentiality
Atria Works will not disclose client information, project details, or site photography to third parties without explicit written consent, except as required to deliver the commissioned Service (e.g., sharing necessary details with a trusted material supplier).
10. Disclaimers
- Atria Works provides design services and professional advice. We do not guarantee specific aesthetic outcomes beyond what is agreed in the proposal.
- Timeline estimates are provided in good faith but may be affected by contractor schedules, material lead times, and site conditions beyond our control.
- We do not act as the principal contractor. Client is solely responsible for contractor agreements, payments, and workmanship unless Construction Companionship is engaged.
- 3D visualisations are representations of design intent and may not precisely replicate the final construction, due to material variations or site conditions.
11. Limitation of Liability
To the maximum extent permitted under Malaysian law, Atria Works' total liability to the Client for any claim arising from or related to the Service shall not exceed the total fees paid for the specific Service to which the claim relates. Atria Works shall not be liable for indirect, consequential, or incidental losses, including loss of profit, loss of opportunity, or loss arising from contractor errors.
12. Termination
Either party may terminate the Agreement by written notice. If the Client terminates after work has commenced, fees for work completed to that point are payable. If Atria Works terminates due to non-payment or a material breach by the Client, fees for work completed remain due. The deposit is non-refundable once a site visit or design work has commenced.
13. Dispute Resolution
In the event of a dispute, both parties agree to attempt informal resolution through direct communication within 14 days of the dispute arising. If unresolved, the dispute shall be referred to mediation under the auspices of the Malaysian Mediation Centre before any legal proceedings are initiated. This Agreement is governed by the laws of Malaysia, and both parties submit to the exclusive jurisdiction of the Malaysian courts.
14. General Provisions
- Entire Agreement: This Agreement, together with any written proposal, constitutes the full agreement between the parties.
- Severability: If any provision is found unenforceable, the remainder continues in full force.
- Waiver: Failure to enforce a provision does not constitute a waiver of the right to enforce it in future.
- Notices: All notices should be directed to legal@atriawor.
15. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted at this URL with a revised date. Continued engagement with our services after an update constitutes acceptance of the revised Terms.
